Changing God's Law

Changing God's Law

Auteure: Nadjma Yassari

Nombre de pages: 358

This volume identifies and elaborates on the significance and functions of the various actors involved in the development of family law in the Middle East. Besides the importance of family law regulations for each individual, family law has become the battleground of political and social contestation. Divided into four parts, the collection presents a general overview and analysis of the development of family law in the region and provides insights into the broader context of family law reform, before offering examples of legal development realised by codification drawn from a selection of Gulf states, Iran, and Egypt. It then goes on to present a thorough analysis of the role of the judiciary in the process of lawmaking, before discussing ways the parties themselves may have shaped and do shape the law. Including contributions from leading authors of Middle Eastern law, this timely volume brings together many isolated aspects of legal development and offers a comprehensive picture on this topical subject. It will be of interest to scholars and academics of family law and religion.

Auteure: Monique-yakout Khentache

Filiation and the Protection of Parentless Children

Filiation and the Protection of Parentless Children

Auteure: Nadjma Yassari , Lena-maria Möller , Marie-claude Najm

Nombre de pages: 417

This book contains selected contributions presented during the workshop “Establishing Filiation: Towards a Social Definition of the Family in Islamic and Middle Eastern Law?”, which was convened in Beirut, Lebanon in November 2017. Filiation is a multifaceted concept in Muslim jurisdictions. Beyond its legal aspect, it encompasses the notion of inclusion and belonging, thereby holding significant social implications. Being the child of someone, carrying one’s father’s name, and inheriting from both parents form important pillars of personal identity. This volume explores filiation (nasab) and alternative forms of a full parent-child relationship in Muslim jurisdictions. Eleven country reports ranging from Morocco to Malaysia examine how maternal and paternal filiation is established – be it by operation of the law, by the parties’ exercise of autonomy, such as acknowledgement, or by scientific means, DNA testing inparticular – and how lawmakers, courts, and society at large view and treat children who fall outside those legal structures, especially children born out of wedlock or under dubious circumstances. In a second step, alternative care schemes in place for the ...

Die Stellung der Frau in der afghanischen Verfassungsordnung im Spannungsverhältnis zwischen islamischem Recht und Völkerrecht - unter besonderer Berücksichtigung des Scheidungsrechts

Auteure: Mina Aryobsei

Nombre de pages: 397

After the fall of the Taliban, the new Afghan constitution of 2004 marks a fundamental beginning for the status of women – at least from a normative perspective. Art. 22 of the Afghan constitution contains: “The citizens of Afghanistan, man and woman, have equal rights and duties before the law.” According to Art. 7 of the constitution the state shall observe i. a. the international treaties to which Afghanistan has joined. This also covers the Convention on the Elimination of All Forms of Discrimination against Women. At the same time, Art. 3 of the constitution provides that no law should contravene the tenets and provisions of the holy religion of Islam in Afghanistan. But how do these different sources of law interact in conflicting legal fields? There are no exiting provisions of the constitution explicitly offering an answer to this problem. This work focuses on the solution of this question regarding the status of women, especially in the law of divorce.

Nombre de pages: 366

This book is the first analysis of parental care regimes in Muslim jurisdictions, both in a comparative and country-specific sense. It contains the proceedings of a workshop on Parental Care and the Best Interests of the Child in Muslim Countries that the Max Planck Research Group “Changes in God’s Law: An Inner-Islamic Comparison of Family and Succession Law” hosted in Rabat, Morocco in April 2015. This workshop saw a total of 15 country reports presented on questions of custody, guardianship and their development within different Muslim jurisdictions (ranging from Indonesia to Morocco), a number of which are included in full in the book. Each of these country reports contains a historical perspective on the evolution of domestic rules regarding custody and guardianship, and on the introduction and development of the notion of the best interests of the child. Most importantly, the prevailing legal norms, both substantive and procedural, are explored and particular attention is given to legal practice and the role of the judiciary. In addition to a selection of country reports from the workshop, the volume includes two comparative analyses on questions of parental care in...

Intersemiotic Perspectives on Emotions

Intersemiotic Perspectives on Emotions

Auteure: Susan Petrilli , Meng Ji

Nombre de pages: 367

This edited volume explores emotion and its translations through the global world from a variety of different perspectives, as a personal, socio- cultural, ideological, ethical and political, even business investment in the latest phases of globalisation. Emotions are powerful in engaging or disengaging individuals, communities, the masses, peoples and nations with distinct linguistic and cultural backgrounds for good, but also for evil. All depends on how emotions are interpreted, that is, translated in “words” or in “facts”, in any case in “signs”. Semiotic reflection on emotions and their interpretation/translation is thus of essential importance. An adequate understanding of emotional phenomena and their complexities calls for different views which together reveal and illustrate inconsistencies in our modern life. The contributors argue that an investigation of types of emotional translation – linguistic and non- linguistic, audio-visual, theatrical, literary, racial, legal, architectural, political, and so forth – can contribute to a better understanding of emotions and how they are exploited to engender injustice, unfairness, absurdity in contemporary life....

Comparative Succession Law

Comparative Succession Law

Auteure: Kenneth G C Reid , Marius J De Waal , Reinhard Zimmermann

Nombre de pages: 833

This third volume in a series on Comparative Succession Law concerns the entitlement of family members to override the provisions of a deceased person's will to obtain money or assets (or more money or assets) from the person's estate. Some countries, notably those in the civil law tradition (such as France or Germany), confer a pre-ordained share of the deceased's estate or of its value on certain members of the deceased's family, and especially on the deceased's children and spouse. Other countries, notably those in the common law tradition (such as England, Canada, or Australia), leave the matter to the discretion of the court, the amount awarded depending primarily on financial need. Whichever form it takes, mandatory family provision is both a protection against disinheritance and also, therefore, a restriction on testamentary freedom. The volume focuses on Europe and on countries influenced by the European experience. In addition to detailed treatment of the law in Austria, England and Wales, France, Germany, Hungary, Italy, the Netherlands, Norway, Poland, Scotland, and Spain, the book also has chapters on Australia and New Zealand, South Africa, the United States, Canada,...

Corpus Juris of Islamic International Criminal Justice

Corpus Juris of Islamic International Criminal Justice

Auteure: Farhad Malekian

Nombre de pages: 770

This pioneering scholarly oeuvre evaluates the major comparative philosophy of Islamic international criminal justice. It represents an in-depth analysis of the necessities of creating an Islamic international criminal court, its possible jurisdiction, proceedings, judgments, and sanctions. It implies a court functioning under the legal personality of the International Criminal Court, with comparative international criminal lawyers with basic knowledge of Shariah contributing to the prevention of crimes and impunity at an international level. The morality and philosophy of Islamic justice are highly relevant with reference to the atrocities committed explicitly or implicitly under the pretext of Islamic rules by superiors, groups and governments. The volume focuses on substantive criminal law and three methods of the criminal procedure, namely the inquisitorial, adversarial, and adquisitorial. The first two constitute the corpus juris of civil and common law systems. The third term presents a hybrid of the first two methods. The intention is to enhance the scope of each method of the criminal procedure comprehensively. The volume examines their variations and effects on a shared...

Children in Migration and International Family Law

Children in Migration and International Family Law

Auteure: Stefan Arnold , Bettina Heiderhoff

Nombre de pages: 315

This open access book offers readers a better understanding of the legal situation of children and families migrating to the EU. Shedding light on the legal, practical, and political difficulties at the intersection of international family law and migration law, it demonstrates that enhanced coordination between these policy areas is crucial to improving the legal situation of families on the move. It not only raises awareness of these “interface” issues and the need for stakeholders in migration law and international family law to collaborate closely, but also identifies deficits in the statutory framework and suggests possible remedies in the form of interpretation and regulatory measures. The book is part of the EU co-financed FAMIMOVE project and includes contributions from international experts, who cover topics such as guardianship, early marriage, age assessment, and kafala from a truly European perspective. The authors’ approach involves a rigorous analysis of the relevant statutory framework, case law, and academic literature, with particular attention given to the best interest of the child in all its facets. The book examines how this principle can be more...

Justice and Beauty in Muslim Marriage

Justice and Beauty in Muslim Marriage

Auteure: Ziba Mir-hosseini , Mulki Al-sharmani , Jana Rumminger , Sarah Marsso

Nombre de pages: 471

The model of marriage constructed in classical Islamic jurisprudence rests on patriarchal ethics that privilege men. This worldview persists in gender norms and family laws in many Muslim contexts, despite reforms introduced over the past few decades. In this volume, a diverse group of scholars explore how egalitarian marital relations can be supported from within Islamic tradition. Brought together by the Musawah movement for equality and justice in the Muslim family, they examine ethics and laws related to marriage and gender relations from the perspective of the Qur’an, Sunna, Muslim legal tradition, historical practices and contemporary law reform processes. Collectively they conceptualize how Muslim marriages can be grounded in equality, mutual well-being and the core Qur’anic principles of ‘adl (justice) and ihsan (goodness and beauty).

Normativity and Diversity in Family Law

Normativity and Diversity in Family Law

Auteure: Nadjma Yassari , Marie-claire Foblets

Nombre de pages: 375

With regard to family law, this volume examines claims based on cultural tradition, ethnic background, custom, religious affiliation and sexual orientation, as well as various other “claims” that are not officially recognized in state law, in 15 jurisdictions around the world. The country reports seek to determine whether these claims represent a challenge to family law as conceived by the state, and if so, how these challenges are being managed. The focus lies on the interaction between (i) claims and traditions raising minority-related and diversity-related issues and (ii) the state as the addressee of these demands for accommodation. The reports identify specific instances and situations that have proven (and in many cases still are) particularly difficult to resolve. They force decision-makers to engage in a delicate balancing act between different, often clashing interests.

Religion and International Law

Religion and International Law

Auteure: Robert Uerpmann-wittzack , Evelyne Lagrange , Stefan Oeter

Nombre de pages: 397

Growing religious antagonisms are challenging the ultimate goal of ‘living together’ in peaceful societies. Living together explores international law responses, beginning with their historic roots, before the perspective shifts to the role of religious institutions and religious law. Contributions of different human rights bodies are analyzed, before further sections deal with the international protection of religion, the relationship between religious beliefs and freedom of expression, and the roles of other individual rights. Religion and International Law originates from the long-standing cooperation between the German and the French Societies of International Law, thus bringing together the traditions of French laicism and a cooperative German approach. Experts from Austria, Italy, Poland, Portugal and the UK complement the pan-European perspective.

Comparative Succession Law

Comparative Succession Law

Auteure: Kenneth Reid , Marius De Waal , Reinhard Zimmermann

Nombre de pages: 680

Intestate Succession is the second volume in the Comparative Succession Law series which examines the principles of succession law from a comparative and historical perspective. This volume discusses the rules which apply where a person dies either without leaving a valid will, or leaving a will which fails to dispose of all of the person's assets. Among the questions considered are the following: What is the nature of the rules for the disposal of the deceased's assets? Are they mechanical or is there an element of discretion? Are particular types of property dealt with in particular ways? Is there entitlement to individual assets (as opposed to money)? Do the rules operate in a parentelic system or a system of some other kind? Are spouses treated more favourably than children? What provision is made for extra-marital children, for adopted children, for step-children? Does cohabitation give rise to entitlement? How are same-sex couples treated? Broader questions also arise of a historical and comparative nature. Where, for example, do the rules in intestate succession come from in particular legal systems? Have they been influenced by the rules in other countries? How are the...

Comparative Law

Comparative Law

Auteure: Uwe Kischel

Nombre de pages: 1099

Uwe Kischel's comprehensive treatise on comparative law offers a critical introduction to the central tenets of comparative legal scholarship. The first part of the book is dedicated to general aspects of comparative law. The controversial question of methods, in particular, is addressed by explaining and discussing different approaches, and by developing a contextual approach that seeks to engage with real-world issues and takes a practical perspective on contemporary comparative legal scholarship. The second part of the book offers a detailed treatment of the major legal contexts across the globe, including common law, civil law systems (based on Germany and France, and extended to Eastern Europe, Scandinavia, and Latin America, among others), the African context (with an emphasis on customary law), different contexts in Asia, Islamic law and law in Islamic countries (plus a brief treatment of Jewish law and canon law), and transnational contexts (public international law, European Union law, and lex mercatoria). The book offers a coherent treatment of global legal systems that aims not only to describe their varying norms and legal institutions but to propose a better way of...
