Armed Conflict and International Law: In Search of the Human Face

Armed Conflict and International Law: In Search of the Human Face

Auteure: Mariëlle Matthee , Brigit Toebes , Marcel Brus

Nombre de pages: 378

This book is written in memory of Avril McDonald, who passed away in April 2010. Avril was an inspired and passionate scholar in the fields of international humanitarian law, international criminal law, human rights law and law in the field of arms control and disarmament. What in particular made Avril’s work special, was her strong commitment with the human aspects throughout. Fourteen scholars and practitioners have contributed to this liber amicorum, which has led to a rich variety of topics within the disciplines of Avril’s expertise. They all have in common that they deal with the human perspectives of the discipline of law at hand. They concentrate on the impact of the developments in international law on humans, whether they are civilians, victims of war or soldiers. This human perspective of law makes this book an appropriate tribute to Avril McDonald and at the same time a unique and valuable contribution to international legal research in the present society. A society that becomes more and more characterized by detailed legal systems, defined by institutions that may frequently lack sufficient contact with the people concerned.

Following the breakdown of the communist system, violent, often ethnic in origin, conflicts erupted in the Balkans, in the Caucasus and elsewhere. Europe was suddenly confronted with nationalist passions and violence not experienced since the Second World War. The present volume, based on a seminar held in Slovenia, analyses some of these conflicts, focusing on the Balkans. The authors explore to what extent law can contribute to a peaceful settlement and prevent wide-scale violations of human rights.

This book contains a collection of essays by leading experts linked to the outstanding characteristics of the scholar in honour of whom it is published, Tullio Treves, who combines his academic background with his practical experiences of a negotiator of international treaties and a judge of an international tribunal. It covers international public and private law related to international courts and the development of international law. Under Article 38 of its Statute, the International Court of Justice can apply judicial decisions only as a “subsidiary means for the determination of rules of law”. However, there are many reasons to believe that international courts and tribunals do play quite an important role in the progressive development of international law. There are a number of decisions which are inevitably recalled as the first step, or a decisive step, in the process of the formation of a new rule of customary international law. In these cases, can the judge be considered as a subsidiary of others? Are these cases compatible with the common belief that a judge cannot create law? Is this a peculiarity of international law, which is characterized by the existence of...

Between 1988 & 1993 over fifty nations have either enacted new mining legislation, had such legislation pending adoption or were in the process of drafting new or revised legislation. In almost every case, this legislation carried with it changes in the fiscal regimes. The ability to attract mineral investment, be it in either a developed or a developing country, is partly dependent on the legislative & fiscal systems which regulate the industry. In the light of the changes taking place, this new reference work is timely & provides essential reading for those with an interest in mining taxation. The first part of the book analyses general topics which are applicable to understanding the taxation of mineral enterprises, while the second part provides a comprehensive & detailed account of actual taxation systems & methods.

Capital and Ideology

Capital and Ideology

Auteure: Thomas Piketty

Nombre de pages: 976

The epic successor to one of the most important books of the century: at once a retelling of global history, a scathing critique of contemporary politics, and a bold proposal for a new and fairer economic system. Thomas Piketty’s bestselling Capital in the Twenty-First Century galvanized global debate about inequality. In this audacious follow-up, Piketty challenges us to revolutionize how we think about politics, ideology, and history. He exposes the ideas that have sustained inequality for the past millennium, reveals why the shallow politics of right and left are failing us today, and outlines the structure of a fairer economic system. Our economy, Piketty observes, is not a natural fact. Markets, profits, and capital are all historical constructs that depend on choices. Piketty explores the material and ideological interactions of conflicting social groups that have given us slavery, serfdom, colonialism, communism, and hypercapitalism, shaping the lives of billions. He concludes that the great driver of human progress over the centuries has been the struggle for equality and education and not, as often argued, the assertion of property rights or the pursuit of stability....

Responding to the Human Rights Deficit

Responding to the Human Rights Deficit

Auteure: Karin Arts , Paschal B. Mihyo

Nombre de pages: 258

Despite the existence of a wide range of human rights instruments and procedures, human rights violations still abound. The authors of this book address this so-called human rights deficit, and the possible responses to it, from various disciplinary angles and mostly in the context of development. They explore the reasons for the continuation of economic, social and/or political exclusion and human rights violations at large. They also present keys for redressing the human rights deficit. The role of law, and questions of universality, inclusion and exclusion are central themes in this book. The need to take up civil and political rights and economic social and cultural rights on equal footing is recognized by several of the authors, and so is that of bridging the public-private divide. Specific contributions address among others the importance of human rights training and education, the role of NGO's in a globalizing world, minorities, gender and women's rights, accountability of multinational corporations, and the problem of human trafficking.
