Grenzschichtforschung / Boundary Layer Research

International Courts and the Development of International Law

Auteure: Nerina Boschiero , Tullio Scovazzi , Cesare Pitea , Chiara Ragni

Nombre de pages: 951

This book contains a collection of essays by leading experts linked to the outstanding characteristics of the scholar in honour of whom it is published, Tullio Treves, who combines his academic background with his practical experiences of a negotiator of international treaties and a judge of an international tribunal. It covers international public and private law related to international courts and the development of international law. Under Article 38 of its Statute, the International Court of Justice can apply judicial decisions only as a “subsidiary means for the determination of rules of law”. However, there are many reasons to believe that international courts and tribunals do play quite an important role in the progressive development of international law. There are a number of decisions which are inevitably recalled as the first step, or a decisive step, in the process of the formation of a new rule of customary international law. In these cases, can the judge be considered as a subsidiary of others? Are these cases compatible with the common belief that a judge cannot create law? Is this a peculiarity of international law, which is characterized by the existence of...

Instability of Continuous Systems

Auteure: Horst Leipholz

Nombre de pages: 422

Until recently there was no uniform stability theory. Different approaches to stability problems had been developed in the different branches of mechanics. In the field of elasticity, it was mainly the so called static method and energy method which were used, while in the field of dynamics it was the kinetic method, which found its perfect expression in the theory of Liapunov. During the last few decades there has been a rapid development in the general theory of stability, stimulated, for example, by the investigations of H. ZIEGLER on elastic systems subject to non-conservative loads, and by the problems arising in aeroelasticity which are closely related to those introduced by ZIEGLER. The need was felt for kinetic methods which could also be used in investigating the stability of deformable systems. Efforts were made to adapt such methods, already known and developed in the stability theory of rigid systems, for application in the stability theory of continuous systems. During the last ten years interest was focused mainly on the application of a generalized Liapunov method to stability problems of continuous systems. All this was done in attempts to unify the various...

Studia Patristica: Historica. Theologica. Gnostica. Biblica et Apocrypha

Auteure: Elizabeth A. Livingstone

Nombre de pages: 428

Papers presented at the Tenth International Conference on Patristic Studies held in Oxford 1987 (see also Studia Patristica 20, 21, 22 and 23). The successive sets of Studia Patristica contain papers delivered at the International Conferences on Patristic Studies, which meet for a week once every four years in Oxford; they are held under the aegis of the Theology Faculty of the University. Members of these conferences come from all over the world and most offer papers. These range over the whole field, both East and West, from the second century to a section on the Nachleben of the Fathers. The majority are short papers dealing with some small and manageable point; they raise and sometimes resolve questions about the authenticity of documents, dates of events, and such like, and some unveil new texts. The smaller number of longer papers put such matters into context and indicate wider trends. The whole reflects the state of Patristic scholarship and demonstrates the vigour and popularity of the subject.

Studies in Medieval Literature and Languages

Auteure: William Rothwell

Nombre de pages: 420

As son of the second president of the United States, father to the minister to the Court of St. James, and grandfather to author Henry Adams, John Quincy Adams was part of an American dynasty. In his own career as secretary of state, President, senator, and congressman, Adams was an actor in some of the most dramatic events of the nineteenth century. In this biography, Lynn Hudson Parsons chronicles the life of one of America's most absorbing figures. From the day in 1778 when as a boy he accompanied his father on a diplomatic mission to France, to his last years as an eloquent opponent of his country's foreign and domestic policies, Adams was rarely detached from public affairs. And yet, this biography reveals Adams as a man never truly at home anywhere - in Washington he was stubborn and reclusive, in Europe he was a phlegmatic ideologue, a bulldog among spaniels. His story parallels America's own.

Precedent in International Arbitration

IAI Series No. 5 The International Arbitration Institute (IAI) series on international arbitration is a new periodic series of publications that will focus on cutting edge issues and developments in international arbitration. About the IAI: The International Arbitration Institute (IAI), an organization created under the auspices of the Comite Francais de l'Arbitrage (CFA), was created to promote exchanges international arbitration. The IAI is designed to promote exchanges on current issues in the field of international commercial arbitration. Its activities include the regular organization of international conferences, colloquiums, as well as conducting various research projects. About the book: Arbitrators routinely refer in their decisions to awards rendered by other arbitral tribunals that deal with the same issues. However natural it may seem to arbitrators and to parties who will refer to arbitral precedents in an attempt to support their position, such an approach raises many practical and theoretical questions: Is there such a thing as arbitral precedent? What weight should arbitrators give to decisions previously rendered by other arbitral tribunals? Can arbitral "case...
